The terms, without the fog

These terms cover www.bocky.co, the founding member program, and the bocky app you install from the Shopify App Store. bocky is operated by AZUA LLC. Installing the app or using this site means you accept these terms.

Using this site

Read it, share it, come back often. Don't scrape it, misrepresent it, probe it for holes, or pass its content off as your own. The bocky name, wordmark and the words on these pages belong to us.

The founding member program

• Requesting founding access is a request, not a purchase. No payment is taken and no card is collected.
• The founding cohort is capped at 100 venues. We review requests and may accept or decline them, usually based on fit and timing.
• Founding members get the founder offer: 50% off the monthly list prices, billed annually, while the eligible annual subscription remains active. The offer is lost on cancellation, uninstall or a switch to monthly billing; an annual plan switch keeps it only when Shopify carries the discount. Paid plans start after the 14 day free trial.
• In exchange we ask for honest feedback. That's the deal, and we mean both halves of it.
• The program's shape (cap, timing, what's included) may be adjusted before launch. Anything already promised to an accepted founding member stays promised.

The bocky app

• Plans and billing. bocky is sold as a subscription through the Shopify App Store. The prices are the ones shown on the listing and on our pricing page at the time you subscribe. Every plan starts with a 14 day free trial; paid billing starts when the trial ends. All charges are billed by Shopify on your Shopify invoice, and annual plans are billed yearly in advance.
• Cancelling. Change plans or uninstall from your Shopify admin at any time. Shopify's billing rules govern when charges stop and whether any app fee is refundable.
• Your store, your guests. People who book, make or redeem through your store are your customers, not ours. You set your prices, run your classes, answer your guests and make refund decisions for your own products. bocky is the software underneath.
• Vouchers. bocky's voucher terms are a starting point, and you can edit them. Rules for gift cards and vouchers differ by country and state, and complying with the rules where you sell is your responsibility.
• Fair use. Don't use bocky for anything unlawful, don't resell or sublicense it, don't reverse engineer it, and don't hammer the service in ways that hurt other venues.
• Whose stuff is whose. The bocky software, name and wordmark are ours. Your ingredient libraries, class content and your customers' saved recipes are your store's data.

What's on this site

We keep this site honest, and we keep it current. Even so, features, dates and pricing can change. Where something matters to your decision, ask us and we'll give you a straight answer in writing.

No warranties, sensible limits

The site and the app are provided as is. We work to keep the app fast and available, and Shopify's platform sits underneath both of us, so no one can honestly promise zero interruptions. To the extent the law allows, our total liability in connection with the site or the app is limited to the app fees you paid us in the 12 months before the claim. Nothing in these terms limits liability that the law says can't be limited.

Talk to us first: hello@bocky.co. Nearly everything is fixable in one email. If we ever end up in a formal dispute, these terms are governed by the laws of Delaware, USA.

Changes

When these terms change, the date above changes, and meaningful changes get a plain-language note.
